Eligibility for Spousal Support

The basic requirement for obtaining spousal support after divorce is that the marriage must have lasted ten years, except in cases where a spouse has been convicted for family violence. In situations where a conviction for domestic violence has occurred, the ten-year requirement is waived, making it possible to obtain spousal support even if the parties have not been married for ten years.

Further, spousal support is not gender specific. The purpose of the support is to help a spouse, male or female, receive the time and training needed to re-enter the workforce and to support himself or herself.

Alimony Modifications

If a marriage is dissolved after ten years, a spouse is eligible for support for up to three years following the divorce decree. Over the course of those three years, the maximum spousal support allowed is either 25 percent of the payer’s income or $2,500, whichever is less.

Should the recipient of spousal support be determined disabled and the disability affects the person’s capacity to work, the individual may be entitled to receive spousal support indefinitely.

Modification to alimony may be required as time passes and situations change. For example, if the party providing support becomes unable to pay, it is possible and advised to contact an attorney and move for an alimony modification before being found in contempt of a court order.
